Rebecca, Palo Alto: Her daughter, age 16, was sexually assaulted on a CalTrain by a conductor. She was caught without a ticket (turnstile jumping) The conductor took her to his booth and demanded oral sex. He wound up getting arrested. He’s out on bail. Rebecca wants this guy to never be in a position of authority again.
Len Tillem: Well, if you listened to Jacob’s call ahead of yours, you know that convictions like this don’t go away, even if they are expunged. And this man—if he’s convicted of a sexual crime he’ll be required to register as a sexual offender. His name and address will come up on the Megan’s Law database.
Your daughter could have a civil lawsuit against CalTrain. Normally CalTrain isn’t responsible for criminal acts of their employees, but there could be liability based on negligent supervision.
She has to file a civil complaint against CalTrain within six months of the incident. They will have 45 days to accept or reject the claim. Then there’s six months to sue.Read more at www.kgoam810.com
